Marketplace Terms of Service

1. What this is
The cloud-ops marketplace lets providers rent out bare-metal servers to renters on a per-day basis (minimum 1 day). We (cloud-ops) operate the platform, take a 15% platform fee on every rental, and use Stripe Connect to handle payouts. We are not the host; the provider is the host.
2. Payments & taxes
Renters pay via Stripe. Funds are escrowed by Stripe and released to providers on Stripe's standard payout schedule (weekly by default). VAT/sales tax is computed by Stripe Tax at booking time using the renter org's billing address.
3. SLA & credits
Each rental targets 99% reachability per hour, measured by our uptime probe. Hours below 99% are credited at (daily price ÷ 24) per missed hour. Credits are applied automatically when the rental finalizes (48h after end of rental); no action required. If you believe an outage isn't reflected, file a dispute within the 48-hour window.
4. Disputes
Both renter and provider can file a dispute within 48 hours of rental end. We review evidence (probe data, sshable, anything attached) and may issue additional credits or transfer reversals. Decisions are final.
5. Data & security
Renters get sudo access to a dedicated user (mp-renter) on the provider's box. At rental end we delete that user and its home directory. We do NOT wipe arbitrary storage — bring your own encryption if you store sensitive data. Providers MUST NOT inspect renter workloads beyond what's needed to keep the box up (see AUP).
6. Termination
We can suspend or terminate listings for AUP violations, fraud, or abuse. We refund renters pro-rata for any pre-paid time they can't use. Providers found in violation lose payout privileges and may be banned from the marketplace.
7. Liability
The marketplace is provided as-is. Maximum liability is the value of the rental in question. We are not responsible for renter workloads, provider hardware failures beyond SLA credits, or third-party damages.
8. Changes
We may revise these terms with 30 days' notice. Continued use of the marketplace after the change date constitutes acceptance.
